Judiciary is the rule of elites

Judiciary is made of judges, who are usually highly educated and hail from elite society. To be dependant on the judiciary is to rely heavily on the benevolence and wisdom of the elites.

Even if they are consciously fair and neutral, biases will still leak through. When humans are unable to make judgements using available data, they tend to use personal preferences unconsiously. This is an example of Substitution bias.

This kind of flawed decision making is similar to AI Takeover ideas, where decisions are being taken without full knowledge of how.
